Franchise - Cooperative Litigation

  • Represented plaintiff cooperative member in action against cooperative involving claims for fraud, breach of fiduciary duty, and negligent misrepresentation. Jury verdict and judgment for member. Judgment for $1.3 million. No. 03 CI-00005; Flegles Inc. v. TruServ Corporation; Carlisle County Circuit Court, Kentucky.
  • Represented defendants against plaintiff franchisee in action for RICO, breach of franchise agreement, and fraud. Take nothing jury verdict and judgment for defendants. Damages claimed exceeded $1 million. No. 86-109; Quarrels v. Popeye’s Famous Fried Chicken, et al.; United States District Court for the Eastern District of Texas, Tyler Division.
  • Represented defendant franchisee against claims for enforcement of personal guaranty for Bojangles restaurants. Favorable settlement prior to trial. Damages claimed of $2 million. No. 85-50287; Insured Pension Investors 1983 v. United Restaurants, Inc.; 164th District Court, Harris County, Texas.
